On Originality
Individuals submitting their work to our platform must send original writings, guaranteeing the journal to be the first publication. Additionally, they must indicate at the time of submission if the work does not meet these characteristics, and the journal reserves the right to reject them.
On Privacy
The names and email addresses entered in this journal will be used exclusively for the purposes established therein and will not be provided to third parties or used for other purposes.
On Open Access (OA)
The journal adheres to the definition of "open access" established by the Budapest Open Access Initiative (BOAI).
Our readers have free and unrestricted access to the works published in the various sections, thus promoting a genuine global exchange of knowledge.
Furthermore, under this open access policy, publishing in the journal will not involve any economic cost for the authors or their institutions. No article processing or submission fees will be charged.
The copyright holder of the academic works published in our journal grants usage rights to others through Creative Commons licenses (CC BY NC SA), which allow free and immediate access to the work. Users may read, download, copy, distribute, print, search, or link to the full texts of the articles, or use them for any other lawful purpose, without needing prior permission from the publisher or the author.
On Data Availability
The journal promotes transparency and reproducibility of all published scientific material, so that other researchers have the possibility to replicate the studies developed in their articles, in accordance with National Law 26.899 on Institutional Open Access Digital Repositories.
To support the reproducibility of results, the journal requires authors to make available, without restrictions, the datasets used in the research described in their article. If there are limitations due to ethical or legal reasons, authors must indicate how other researchers can access such data.
Authors are requested to use formats that maximize data accessibility and reusability (for example, when using tabular data, a spreadsheet is suggested).
If necessary, it is recommended to publish alongside the data the algorithms or processing steps required for proper interpretation.
On Preservation
All content published in this journal is stored on servers of the Universidad Nacional del Oeste.
Automatic backups, remote copies, format adjustments, integrity checks, and other activities required to ensure digital preservation are carried out through this institutional website.
Additionally, each issue is deposited in Internet Archive.
On Self-Archiving
The Legal Journal of the Universidad Nacional del Oeste adopts an open policy regarding the deposit and self-archiving of articles, allowing authors to freely share them across various digital platforms. This includes personal websites, academic repositories, blogs, institutional platforms, and any other electronic medium. Both the pre-peer review version (pre-print) and the post-review version (post-print) are authorized, with the aim of promoting visibility, circulation, and preservation. However, it is suggested that the final version published by the journal be disseminated, accompanied by the citation, persistent DOI identifier, and bibliographic data corresponding to its original publication.
On Ethics
The journal adheres to the CODE OF CONDUCT AND BEST PRACTICE GUIDELINES FOR JOURNAL EDITORS (COPE, 2011).
The Universidad Nacional del Oeste maintains a permanent commitment to the ethics and quality of its publications. Therefore, we promote and demand intellectual honesty from all parties involved in our publication. Authors, editors, members of the Editorial Team, proofreaders, and members of the Editorial Board must adhere to our guiding principles.
On Plagiarism
All written articles will be reviewed using the plagiarism detection software “Plagiarism Checker.”
Without prejudice to actions by third parties against authors, the Editorial Board of the Journal of the Judicial School may decide not to accept further articles from authors who submit works with:
- Redundancy: use of datasets with findings identical to those in previously published articles and/or evidence that authors attempted to conceal redundancy (e.g., changing the title or author order, or failing to reference previous articles).
- Use of another author's ideas or words as their own.
- Obvious plagiarism: use of a large portion of text or data without attribution, presented as if it were the plagiarist’s own work.
- Minor copying of short phrases only (e.g., in the discussion section of a research article by a non-native speaker) or citation manipulation (e.g., not using quotation marks for a literal quote; providing incorrect source information; paraphrasing without citing the source; excessive paraphrasing even if the source is mentioned).
- Invented, fabricated, or omitted data.
- Submission of another author's work as their own.
- Publication of several similar articles under different names or author aliases.
Dishonest practices related to plagiarism and the various detected cases will be discussed by the Editorial Board members, who will decide on the measures to be taken, guided by the COPE flowcharts (see COPE flowcharts and Spanish-translated resources).
