A modern conception of the judicial process requires emphasizing the value of 'efficacy' in the jurisdictional function and the instrumental nature of procedural rules, in the sense that their purpose lies in making effective the substantive rights that require protection. Within this framework, measures of the type requested appear as one of the appropriate means, during the course of the trial, to ensure the proper delivery of justice and to avoid the risk of a favorable but ineffective judgment due to delay
