Abstract

On November 21, 2024, the country's highest court ruled on the case file CCC 45877/2012/TO1/3/CS1 “Guerra, Sebastián Alejandro et al. s/ extraordinary appeal incident” (Supreme court “fallos” collection: 347:1770), in a ruling that, without a doubt, had great and diverse repercussions related to the constitutionality of life imprisonment and what exactly was the scope of the resolution. This circumstance invites us to investigate and deepen our knowledge regarding
the inherent conflict in the case, and how the prohibitions to access parole under Article 14 of the Penal Code should operate with respect to individuals sentenced to life imprisonment and their rights not affected by prison sentences.
