Abstract

This paper addresses the different perspectives on the viability of applying usucapion or acquisitive prescription institute of private law to the administrative servitude of electroduct, typical of public law. To analize this issue, we focus on the characteristics of administrative servitude of electroduct within the framework of administrative law and the requirements provided for in specific legislation, established in the law of administrative servitude (Law num. 19.552, 1972) and the electric energy regime (Law num. 24.065,1992). Finally, various sentences handed down by the higher court − Appeals Chamber in Federal Administrative Litigation− that currently have consolidated uniformity in the conception of the institute of study, will be considered in orden to formulate some conclusions.
