FEMICIDE: THE IMPORTANCE OF ITS CATEGORIZATION IN ARGENTINIAN CRIMINAL LAW

Abstract

This article addresses with gender perspective the incorporation of the figure of femicide in the Argentinian Penal Code. After a brief historization of the concept, we describe the international standards of enhanced due diligence for the investigation of these cases. We analyse the importance and the consequences at the Provincial level of adhering to the Protocol for the investigation and litigation of cases of violent deaths of women (UFEM Protocol) and the measures adopted by the Supreme Court of the Province of Buenos Aires and the Public Ministry of the Province of Buenos Aires, as well as by the Public Prosecutor's Office of Cassation.

Recognizing the importance of analyzing cases in a complex manner in the light of historically
generated power relations is essential for women and the families of victims of femicides to have
access to justice.
