Environmental crimes in the Draft of the 2025 Criminal Code

The text analyzes the draft of the 2025 Argentine Criminal Code on environmental crimes within the framework of a historic change compared to the current system, characterized by scattered regulations and indirect protection of the environment. It highlights the constitutional recognition of the right to a healthy environment and the need to overcome the exclusively anthropocentric criminal approach by admitting the environment as a legal interest in its own right. Likewise, the text points out that environmental protection cannot be limited to the punishment of harmful behaviors, but requires a comprehensive approach that combines sanction, management, and prevention, consolidating a coherent legal framework that articulates social responsibility in defense of the environment.
